WHY COURT AWARDED HOUSE CURTAINS TO A WOMAN WHO FILED FOR DIVORCE

A woman who filed for divorce anticipating to have a reasonable share on the family’s wealth was astonished and left court crestfallen, as court awarded her only house curtains.

Peace Uhirirwe committed her husband Dr. Paul Kaggwa to family court accusing him of having an affair with another  woman yet they were officially married and ask court to end their marriage and order the divorce couple to share the accumulated wealth equally.

Incidentally after court hard both sides of the plaintiff and the defendant, decided that Uhirirwe be given only curtains and one cattle from Dr. Kaggwa’s located in Ntungamo District.

In her submission document  Uhirirwe  stated that the family had a maternal house in Lubowa located at plot 1053, block 410 and others, in Bukoto on plot 87 in Kampala Central Division, plot 63 Nakiwogo Road Entebbe Municipality, plot 3 Ssese Walk Entebbe, and Block 415,416, also plot 32, Bugiri Kisubi in Mpigi Town.

In her judgment, justice Alice Khaukha Komuhangi of Family Division Court stated that Uhirirwe be given only house curtains worth of  2,800 000 and ordered Dr.Kaggwa to pay this amount in a period of thirty days counted since April 14 we she made the judgment.

The justice Komuhangi contends that Uhirirwe didn’t contribute to the accumulation of the wealth she purportedly wanted to have a share after divorce, that evidences indicate clearly that by time of marriage Kaggwa had already accumulated his wealth.

Uhirirwe in her court submission maintains that she got married to Dr. Paul Kaggwa in December 16, 2005, at Our Lady Queen of Virgins, Kisubi Parish. And she was betrayed by her submission because she informed court that by time marriage Kaggwa had already accumulated that wealth she wanted to have a share.

She also argued that since they were legally married in church, the wealth belongs to both of them and she had a share and that the maternal family house at Lubowa by time of marriage was still on foundation level and that was completed in 2006 and in July the same year they started sleeping in it until November 2013 when she decided to separate from her husband.

This however didn’t convince the judge and she decided the case in favor of the defendant(Kaggwa) because the evidence Uhirirwe filed alleging that her husband had another illegal relationship with a one Diana Natukunda wasn’t true.

In the judgement, justice Komuhangi maintained that Uhirirwe had no any hand in wealth she wanted to have a share since she found when Kaggwa hard accumulated some of the wealth and should only pay 2,800,000 for the curtains that was spent on curtains.

On the issue of having an affair with another woman, court pronounced that Diana Natukunda whom Uhirirwe alleged Kaggwa to be having a love relationship was not true because during the period the couple were in marriage, Dr. Kaggwa the defendant was instead in a love affair with another woman called Doreen Arinaitwe with whom they have a child and this convinced court to grant divorce to the applicant.

Still in her submission, Uhirirwe asked court to grant her 10 cattle from the purported family farm located in Ntungamo alleging that she is the one who established it on behalf of the family but the defendant (Dr. Kaggwa) told court that he knows only one cattle on the farm that they got during their wedding function and was ready to forfeit it to Uhirirwe.

On this matter the judge agreed with the defendant because Uhirirwe didn’t confirm in her submission document that she indeed installed 10 cattle and there was no evidence that the cattle they got had produced at least 10 and she there order the defendant to give one cattle to the plaintiff.

The plaintiff (Uhirirwe) also asked court to order Dr. Kaggwa continue providing for her necessities because they were married officially but court refitted this on grounds that the plaintiff hand a permanent job in UNICEF and can ably cater for herself.
