PRESIDENT MUSEVENI AND NRM PARTY IS KEEPING AKENA IN OFFICE ILLEGALLY- COUNSEL WALUBIRI

City Lawyer Peter Mukidi Walubiri and Uganda People’s Congress (UPC) party leader of opposing faction said with the current trend of the political situation, Uganda is likely to head into a political anarchy like is the case with Libya and Sudan if Ugandans don’t come out and decide their future.

He said that President Museveni and his NRM party all along has been working to destroy UPC and all other opposition political parties  and he has worked had to achieve his wishes.

Walubiri who heads the opposing faction said that this explains why even after Supreme Court ruled against Jimmy Akena that he is holding the highest UPC office illegally, he is still occupying office premises and also performing activities as party president.

“As long as Mr. Museveni with his NRM Party is still in power, Court and other institutions like political parties will not function well because no single institution has been spared by Museveni.’’ Walubiri said.

He further said that, “ Court will not function well; they are part of the problems especially in politics of the country. We go to court because we have no alternatives we shall try to expose them and see whether they can be able to improve.’’

He also said that he has however written to him asking him to vacate the office of the party peacefully but he has remained adamant and that he will find means of throwing him out forcefully.

In 2015, some party members led by the late Joseph Bbosa, Prof. E. Kakonge and Otto Isha Amizza petitioned court seeking to reverse what they called the unconstitutional and violent takeover of the Party leadership by Jimmy Akena.

Court declared that the election of Hon. Jimmy Akena as UPC President was illegal and void and that the exercise violated UPC Constitution. The Court also ordered the Party to hold fresh election.

Akena being dissatisfied with the judgement of the High Court filed Civil Appeal against the judgement he then turned around and instead obtained an interim order of stay of execution from Deputy Chief Justice then Stephen Kavuma and was granted until the he has been using this order to stay in office.

However, Walubiri while addressing Journalist at Speke Hotel in Kampala said that, Prof. Kakonge also moved to the Court of Appeal to fix a hearing date but Akena issued a notice for delegates’ conference to be held on 1st August 2020 with an intention of   electing a Party President so as to pre-empty the decision of the Court of Appeal.

In the same year following orders of Court of Appeal, Walubiri’s faction also organized set up an electoral commission which conducted lections and Peter Mukidi Walubiri emerged as the winner of the elections which so four people contesting for the highest office. Others who contested were, Dr. Dan Okelllo , Joseph Othieno and Dr. Opul Dickson.

“ I am the dully elected UPC Party President but because Jimmy Akena and his family wanted food to eat that is why they sold their soul to NRM party and Museveni is helping them to hold office illegally,  good enough they went as individuals and the party the legitimate party leadership is not bothered by their acts.’’ Counsel Walubiri explained.

Walubiri said that he is going to embark on rebuilding the party starting with census to find out which members are still alive and with the party, registration of new members, strengthening leadership get the accounts of the party and mobilize resources.
