SUPREME COURT DEFERRED DTB VS HAM ENTERPRISE BACK TO HIGH COURT

Circus, as Supreme Court sitting at Plot 5 Lourdel Road in Nakasero, Kampala referred the case between DTB vs Ham Enterprise back to the high court.

Justice Percy Tuhaise ordered the case to be revisited and heard again by the high court but at the same time she dismissed the issue of illegality which Ham Enterprises Lawyers of Muwema & Company advocate were challenging.

Justice Tuhaise accepted and agreed with Ham Enterprise lawyers’ defense argument that there is no law supporting DTB Uganda and DTB Kenya transactions but she dismissed the ideal of DTB bank operating without a local license and said it doesn’t hold merit and she ordered Hamis Enterprises to pay half the costs incurred by DTB in this case.

Counsel Roberts Kagolo of Muwema & CO. said that he is satisfied with the Supreme court’s ruling of the illegality of the transaction carried out between DTB Uganda and DTB Kenya.

“I must say that on behalf our client, we are satisfied with the court’s ruling that they loans between the two branches of DTB bank were syndicate loans which had no legal backing.’’ Kagolo said.

He also said that he has not received the formal judgment but they will decide what to do next after meeting their client Hamis Kiggundu and receiving the written judgment.

In October, 2020, Commercial Court Judge Henry Peter Adonyo ruled in favor of Kiggundu, ordering DTB Uganda to refund all funds deducted from his accounts. It was alleged that these deductions were made without Kiggundu’s consent.
