THREE CHARGED FOR ROBBERY AND UNLAWFUL POSSESSION OF A FIRE ARM.

The UPDF’s General Court martial sitting in Makindye Kampala and chaired by Brig Gen Freeman Mugabe has today 8th May 2023 charged three persons for robbery and unlawful possession of a fire arm. The three are Lutaya Denis, Luyimbazi Gerald and Kasozi Abubaker . Court heard that on 17th feb 2023 the said people in Nakatete village Lwengo District robbed one Muwezi of his car number UBH 093B Toyota Wish valued at 24 million at gun point.

They have been charged for count 1,robbery c/s 185 and 186 (2) of the penal code Act and count 2 ,unlawful possession of a fire arm c/s 3(1) and (2) of the fire arms act cap 299 with out a valid fire arms certificate. They pleaded not guilty to the charges and have been remanded to Kitalya government prison.

BRIEF FACTS ON AGGRAVATED ROBBERY CASE OF SEKAYINGO JUMA AND LUBEGA SWAIBU.

  • Court heard tht Ssekayigo Juma and Lubega Swaibu on the 9th March 2019 armed with a pistol , raided Sekyewa Martin of Katale Wakiso of his 2 Laptops, Camera,500 k ,180 US dollars .

*They were arrested and arraigned before the General court martial on the 23rd April 2019 and charrged with aggravated robbery c/s 285 and 286(2) of the penal code Act and pleaded not Guilty .

*The stolen vehicle was later recovered

*As the case progressed, Lubega Swaibu was given bail but later went missing leaving his co accused alone .

*prosecution prayed for a deterrence sentence since Ssekayigo Juma is a habitual offender and always arrested in connection of using deadly weapons .

*He’s been in lawful custody for four years and was arrested aged 17 years.

  • He accepted the brief facts of the case and co consecutively the Chairman Brig Gen Freeman Mugabe informed him he’s convicted on his own plea of guilty.
  • counsel for the accused prayed for a lenient sentence since he was arrested as a child buh court tasked the counsel to bring last proof before sentencing is done.
